U.S. Supreme Court Reaffirms Visa Waiting Time Law

WASHINGTON — The U.S. Supreme Court ruled that illegal immigrant children, once they turn 21 years old, have to restart their wait for immigration visas.

scotus at sotu [1]Reuters reported [2] that the opinion was close, a 5-4 vote, which said that only in limited circumstances can federal immigration law allow children to retain their place in line when they turn 21 years old.

The program in question allows U.S. citizens or legal residents to sponsor relatives who live overseas, where people wait years for approval of their visa applications and where visa availability has a cap each year.

The federal government interpreted the law as only children of permanent U.S. residents were eligible to keep their place in the visa wait line when they turned 21.
