Dear Mr. Chertoff:

The Senate version of the immigration bill attempts to legalize not only illegal aliens but the Security & Prosperity Partnership (SPP), a trilateral scheme involving the governments of the U.S., Mexico and Canada. But this is backwards. The SPP should have been approved by Congress before the President announced it in 2005. As a former Assistant Attorney General in the Justice Department and former United States Circuit Judge for the Third Circuit Court of Appeals, you should know that the SPP cannot be implemented by the president on his own. This administration initiative should be submitted as a treaty requiring the advice and consent of the U.S. Senate.
